Kiva Stays – Terms and Conditions

Welcome to Kiva Stays, a short-term rental property located in Orbisonia, Pennsylvania (“the Property”). By booking and staying at Kiva Stays, you (“Guest”) agree to the following Terms and Conditions. Please read them carefully before confirming your reservation.

1. Rental Agreement

Your booking constitutes a legally binding short-term rental agreement between you (the Guest) and the property owner/operator of Kiva Stays (“Owner”). By completing a reservation through Airbnb or directly via the Kiva Stays website, you acknowledge and agree to abide by these Terms and Conditions.

2. Booking & Payment

  • Reservations must be made by individuals 18 years or older.
  • All bookings must be accompanied by valid identification and full payment via Airbnb or the Kiva Stays website.
  • No security deposit is collected; however, Guests remain financially responsible for any damage, loss, or excessive cleaning resulting from their stay.

3. Check-In / Check-Out

  • Check-in: 4:00 PM or later
  • Check-out: 11:00 AM
  • Kiva Stays offers self-check-in via a keypad code provided prior to arrival.
  • Early check-in or late check-out is subject to prior approval and availability.

4. Guest Responsibilities

Guests agree to:

  1. Use the Property for personal, residential, short-term purposes only.
  2. Maintain the Property in good condition and immediately report any issues or damages.
  3. Follow all posted house rules, including quiet hours, parking limits, and maximum occupancy.
  4. Not engage in illegal, commercial, or disruptive activities.
  5. Not smoke or vape inside the Property (unless explicitly stated otherwise).

Violation of these terms may result in immediate termination of stay without refund.

5. Damages and Liability

  • Guests are liable for any damage, loss, or excessive cleaning required as a result of their stay.
  • The Owner reserves the right to charge for damages or additional cleaning fees through Airbnb’s Resolution Center or by invoicing the Guest directly (if booked through the Kiva Stays website).
  • The Owner is not responsible for:
    • Accidents, injuries, or illnesses that occur while on the Property;
    • Loss or theft of personal belongings;
    • Power outages, weather conditions, or other events beyond the Owner’s control.

By booking, the Guest assumes all risks associated with use of the Property and releases the Owner from any liability to the fullest extent permitted by Pennsylvania law.

6. Cancellation Policy

Kiva Stays follows a moderate cancellation policy:

  • Full refund for cancellations made at least 30 days before check-in.
  • Cancellations made within 30 days of check-in will result in a charge for the first night and 50% of the remaining nights.

If the Owner must cancel for any reason, Guests will receive a full refund.

7. Occupancy and Visitors

  • Maximum occupancy: 4 guests.
  • Additional overnight guests are not permitted without prior approval.
  • Unauthorized guests or parties are strictly prohibited and may result in termination of stay without refund.

8. Maintenance and Access

The Owner or authorized personnel may enter the Property for urgent maintenance or safety concerns with reasonable notice to the Guest.

9. Force Majeure

The Owner is not liable for failure to perform obligations due to events beyond their control, including natural disasters, government actions, power failures, or other unforeseeable events.

10. Governing Law

These Terms and Conditions are governed by and construed under the laws of the Commonwealth of Pennsylvania. Any disputes arising under this Agreement shall be resolved in the appropriate courts located in Huntingdon County, Pennsylvania.

11. Acceptance of Terms

By booking Kiva Stays, the Guest acknowledges that they have read, understood, and agreed to all the Terms and Conditions outlined herein.
